Delivery and Returns

DELIVERY

The boutique "Chez Maman" ships worldwide. The delivery cost of your order will be calculated at checkout. Standard delivery is free for orders over €500 in France and worldwide. Your order will be delivered on the date specified in the Shipping Confirmation or, if no date is given, within 30 days after the Shipping Confirmation (in exceptional circumstances). Your order will be delivered to the address provided during your order. If your delivery address is remote, we may not be able to deliver to that address. If this applies to you, you will be informed before we accept your order. We reserve the right not to deliver to any country prohibited by export laws and regulations. Orders cannot be delivered to P.O. Boxes or similar addresses. Products in the same order cannot be delivered to different delivery addresses. Deliveries are made by our courier services and are organized between Monday and Friday, excluding holidays, typically between 10 AM and 5 PM. If you order products requiring international delivery, they may be opened and inspected by customs authorities and may be subject to import taxes payable upon receipt of your order. You will be responsible for these import taxes. If you wish to return an item, the import taxes will be refunded if they were included in the purchase price. If they were not included, you will be responsible for handling the recovery of these taxes with your customs authorities.

DELIVERY TIMES

- For most destinations in Europe and the USA: delivery in 2-5 days - For the rest of the world: delivery in 4-10 days Import duties and taxes for the following countries: European Union, United States, Canada, China, Australia, New Zealand, Puerto Rico, Switzerland, Singapore, South Korea, Kuwait, Qatar, Israel, India, Norway, Saudi Arabia, Taiwan, United Arab Emirates, Japan, and Mexico. We ship to these countries with import duties paid and included. You will not receive any additional invoices upon receiving your order. If you order from your own customs area or country, import duties do not apply, but you may have to pay VAT or local sales tax. For customers in the rest of the world, we ship orders with import duties to be paid. This means that import duties are not included in the prices you see online. You will not have to pay VAT or sales tax, but there may be other local taxes you need to pay to receive your order.

RISKS AND OWNERSHIP

The products ordered are your responsibility from the moment of delivery or collection. Ownership of the products will transfer to you once the products have been delivered or collected, provided payment for the products and delivery have been received.

PRICES AND PAYMENT

The prices of the products are as indicated on the site. The currency is Euro (€). Prices include VAT but do not include delivery charges, which will be automatically added to the total amount when you access your cart and choose your delivery method. The site contains a large number of products, and it is always possible, despite our best efforts, that some products may be listed at an incorrect price. We typically verify prices during the shipping process so that, if a product is listed at a lower price, we will ask you to pay the lower price. If a product is listed at a higher price than the one on the site, we will contact you for more information before shipping the order, or we will refuse your order and notify you at our discretion. Payments for all orders must be made via PayPal, credit card, or debit card. We accept most credit and debit cards. Online payments are subject to validation by the card issuer, and we are not responsible if they decline a payment for any reason. Please note that some card issuers may charge a processing fee, which we are not responsible for. We occasionally run promotions that require promotional codes. These can be used to partially pay for one or more products ordered online, subject to the terms and conditions under which they were issued. Promotional codes can only be used once during the specified period and apply to the indicated products. Promotional codes cannot be exchanged for money.

RETURNS

If you are not satisfied with the product you purchased, we commit to either exchange it or refund you.

  • For refunds: return shipping is FREE in France (excluding sales & promotions) and at the customer's expense abroad.
  • For exchanges: return shipping is at the customer’s expense, and reshipping of the product(s) in the new size is FREE.

You have 14 days from the receipt of the product(s) to return them. Returned products must comply with our return policy below. You have a legal obligation to take care of the products while in your possession, and you must return them in the same condition you received them:

  • - Clothing must be returned unworn, unwashed, undamaged, and with original tags.
  • - Shoes and accessories must be returned in their original boxes and inside a parcel.
  • - If the product was delivered with a security tag, it must remain attached.
  • - Hosiery must be returned in its unopened packaging.
  • - Lingerie and swim shorts must be tried on over your own lingerie.

If you fail to meet the above obligations (return conditions included), we may deduct an amount up to the total value of the product based on the depreciation caused by how you handled the product.

YOUR CANCELLATION RIGHTS

Except for certain types of products (as mentioned above), you can cancel a contract before your order is delivered and up to 14 days after, starting from the day of receipt of the products (“waiting period”). To cancel a contract, you must inform us by email through the “Contact” section, providing your name, address, and reference number. If you cancel an order (or part of an order) during the waiting period, the products must be returned within 14 days from the date you contacted us and must meet our Return Policy. If you cancel a contract within the 14-day waiting period (as outlined above), we will process your refund as quickly as possible, or in any event, within 14 days from the day we receive the returned products or when we receive proof that you returned the products to our return address before the 14 days expire, we will process the refund on that date. We will refund the amount of the product(s) in full (except for any deductions we are entitled to make due to your use or damage to the product(s)) as well as the cost of standard delivery. However, we will not refund the cost you paid to send the product(s) to us, as this cost is your responsibility.

STEPS

Please print the shipping label and attach it to the outside of the parcel. You must also give a copy to the courier. Please keep an electronic copy of the air waybill for your records. Please note that you have 30 days from the return date to contact us and verify that the return has been received. After this 30-day period, we cannot guarantee a refund. You will be refunded via the payment method used during your order. Please note that we will not be able to refund the delivery charges for your order. Refunds via PayPal will automatically be processed to your PayPal account. Please note that with card payments, refunds may take up to 14 days, depending on your bank.

DEFECTIVE PRODUCTS

If any of the products delivered are defective or damaged upon receipt, you have several legal options available, depending on when you report the issue and your legal rights. If you believe any product(s) delivered are damaged or defective, you must inform us as soon as possible, preferably in writing, providing your name, address, and reference number.

PRODUCT INFORMATION

Although we take all precautions to ensure that the products are accurately described with the photos available on the site, some details (such as color, patterns, or texture) may vary depending on your screen resolution and may slightly differ from the product you receive. Any information on the site regarding size is for guidance only. If you are unsure about the size, we recommend contacting us before placing your order. You must use the "Chez Maman" site and its content legally (in accordance with all applicable laws and regulations), responsibly, and in no way that may harm our name, reputation, or that of our partners. Any rights granted in accordance with these terms and conditions will be revoked if you break them.

INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights to the content of the site belong to "Chez Maman." Outside of the conditions established in these terms and conditions, you have no intellectual property rights over our content, and you acknowledge that you do not obtain any ownership rights by downloading all or part of the content from the site. If you print, copy, or save certain pages from the site (in accordance with these terms and conditions), you must ensure that all copyrights, trademarks, or any other intellectual property notices included in the original content are reproduced.

CONTENT

We may change the content and format of the site from time to time. You agree that your use of the site is based on the content and format as it appears and at your own risk. We make no guarantees regarding the accuracy, completeness, currency, integrity, quality, relevance, or originality of any or all content on the site, and in accordance with the law, all implied warranties, conditions, and other terms are excluded, and we accept no liability for loss or damage of any kind resulting from your use of the site's content. We cannot guarantee, and do not guarantee, that all or part of the site's content is free from viruses and/or any other code that may contain contaminants or destructive elements. It is your responsibility to put in place the necessary electronic safeguards to ensure the content meets your security and reliability requirements.

OUR LIABILITY

These terms and conditions do not limit or exclude our liability for: - Death or personal injury caused by our negligence; - Fraudulent misrepresentation; - Violation of terms implied by the Consumer Rights Act 2015, which cannot, by law, be limited or excluded; - Violation of terms implied by Part I of the Consumer Protection Act 1987; or any other liability that cannot be limited by law. Subject to the above, under no circumstances will we be liable for any loss of profits, and any liability arising from a contract will not exceed the purchase price of the product(s) concerned and will be limited to losses that are reasonably foreseeable. Foreseeable losses are losses that could have been contemplated by you or us at the time the order was placed. We will not be liable for failure to fulfill or delays in performing any of our obligations under any contract if the delay is caused by events beyond our reasonable control.

GENERAL

You may not transfer or assign any part of the rights and obligations of any contract. Any notices you wish to send us must be submitted in writing to the address provided at the end of these terms and conditions. We will contact you by email or postal mail to the address provided during your order. If we are unable to exercise any of your rights, this does not mean a waiver of them. If any provision of these terms and conditions is found to be unenforceable, all other provisions will remain intact. These terms and conditions may not be modified without our written consent. These terms and conditions, and any document referred to in them, represent the entire agreement between you and us regarding any contract. We must inform you that contracts can only be concluded in English, and no public filing requirement applies. These terms and conditions are governed by English law, and you agree that any dispute between you and us regarding any contract will be resolved by the English courts, provided that if you live in a part of the UK other than England, the applicable law of that part of the UK will govern and any dispute will be heard by the relevant courts.
